Small Estate Affidavit

A Small Estate Affidavit is a legal tool to settle an estate that does not own any real property.  Laws relating to small estates were enacted in order to enable heirs to obtain property of the deceased without probate, or with shortened probate proceedings, provided certain conditions are met.

Small estates can be managed with less time and money. If the deceased had conveyed most property to a living trust but there remains some property, small estate laws may also be available.

Collection of property by a Small Estate Affidavit under Idaho Law as of 2014 requires that the fair market value of the entire estate of the decedent which is subject to probate, wherever located, less liens and encumbrances, does not exceed one hundred thousand dollars ($100,000).
